Commitment to Group Culture

As a member of a private Accountability for Success Unit, I commit to fostering a culture that promotes growth, support, and accountability. To create a positive and productive environment, I pledge to adhere to the following principles:

1. Attendance and Participation:
I commit I will attend my Unit’s bi-monthly group meeting via Zoom and actively participate in group activities. My commitment to my unit and it’s members is a cornerstone of both my and the group’s collective success. I commit I will provide a daily stand-up message in the Unit’s private Alignable group thread. I understand this is an integral action on my part to maintain focus and accountability to both myself and the group members.

2. Privacy and Respect:
I respect the privacy and confidentiality of all group members. I understand that sharing personal or sensitive information is a part of my journey, and I pledge to uphold trust and discretion. As such, I acknowledge I will follow Unit Non-Disclosure Agreement and agree to its terms and conditions

3. Premium Membership:
I agree to become and/or maintain a Premium Member of the Alignable Platform. I understand my continued participation in the private sub-group is contingent upon maintaining said paid membership.

4. Honest and Detailed Sharing:
I pledge to share my progress, challenges, and successes openly and honestly. Detailed sharing allows group members to provide and receive valuable feedback and support.

5. Utilizing Provided Tools:
I commit to using the tools, platforms, and resources provided by the group to enhance my accountability and collaboration.

6. Constructive Feedback:
I will offer constructive and respectful feedback to help my fellow members grow. I understand that feedback is a valuable resource for personal and professional development.

7. Adaptability and Growth:
I acknowledge that personal and group growth require adaptability and a willingness to learn from experiences and mistakes.

8. Encouragement and Positivity:
I will encourage and support each member in our pursuit of goals. Positivity and motivation are key to our collective success.

9. Responsible and Ethical Behavior:
I commit to responsible and ethical conduct within the group, adhering to principles of integrity and fairness.

This commitment to the group culture is fundamental to my journey of mutual support, achievement, and personal growth. It ensures that I continue to thrive as a group member dedicated to success.

Unit Confidentiality Agreement

PRIVATE GROUP NONDISCLOSURE AGREEMENT

This Private Group Nondisclosure Agreement (“Agreement”) is entered into on the e-signed date, by and between each member of this group as each member is both a disclosing and receiving party of confidential information. Collectively, the Disclosing Party and the Receiving Party may be referred to as the “Parties.”

WHEREAS, the Parties anticipate participation in a private group (the “Group”), where sensitive and confidential information may be shared;

NOW, THEREFORE, in consideration of the premises set forth herein, the Parties agree as follows:

Definition of Confidential Information

“Confidential Information” shall mean any and all information disclosed by the Disclosing Party to the Receiving Party during the course of their participation in the Group. This includes, but is not limited to, any discussions, materials, documents, ideas, strategies, plans, or other information that is non-public, confidential, or proprietary in nature.

  • Confidential Information shall not include information that:
    Was known to the Receiving Party prior to disclosure by the Disclosing Party;
  • Is or becomes publicly available through no fault of the Receiving Party;
  • Is independently developed by the Receiving Party without reference to the Confidential Information; or
  • Is rightfully obtained by the Receiving Party from a third party without a duty of confidentiality.

Obligations of the Receiving Party

The Receiving Party agrees to keep all Confidential Information confidential and not to disclose, publish, or reveal it to any third party without the prior written consent of the Disclosing Party.

The Receiving Party agrees to use the Confidential Information solely for the purpose of participation in the Group and shall not use it for any other purpose without the prior written consent of the Disclosing Party.

The Receiving Party shall take reasonable measures to protect the confidentiality of the Confidential Information, including but not limited to using the same degree of care as it uses to protect its own confidential information of a similar nature, which shall be no less than a reasonable standard of care.

The Receiving Party shall promptly notify the Disclosing Party in writing of any unauthorized disclosure or use of the Confidential Information and shall cooperate with the Disclosing Party in any efforts to enforce this Agreement or seek remedies for such unauthorized disclosure or use.

Term and Termination

This Agreement shall commence on the Effective Date and shall remain in effect until terminated by either Party upon written notice to the other Party.

Return of Confidential Information

Upon the termination of this Agreement or upon the written request of the Disclosing Party, the Receiving Party shall promptly return or destroy all Confidential Information and any copies, summaries, or extracts thereof, in any form or medium, and shall certify in writing to the Disclosing Party that such Confidential Information has been returned or destroyed.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of laws principles. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located within the Collier County, Florida.

The disclosing and receiving parties agree to indemnify, defend, and hold harmless accountability.guide, Alignable, along with the respective officers, directors, employees, agents, and representatives (collectively, the “Indemnified Parties”) from and against any and all claims, suits, actions, demands, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with any third-party claim, suit, or proceeding to the extent it arises from the use or misuse of confidential information shared and/or disclosed to any unauthorized party.

Entire Agreement

This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties.

If any provision of this Agreement is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed modified to the extent necessary to render it valid, legal, and enforceable, and the validity, legality, and enforceability of the remaining provisions of this Agreement shall not be affected or impaired in any way. Any such modification to or invalidity of a provision shall not affect the intent of the parties as reflected in that provision. The parties further agree to negotiate in good faith to replace any such invalid or unenforceable provision with a valid and enforceable one that achieves, to the extent possible, the economic, business, and other purposes of such invalid or unenforceable provision. This Severability Clause shall apply to the maximum extent permitted by applicable law.
